Our Policy:

Welcome to the web site (oohlalamobile.com, the “Site”) and Services (as defined below) of OOHLALA Mobile, Inc. (“OOHLALA Mobile”, “we”, “us” and/or “our”). This Site and the Services are operated by OOHLALA Mobile and have been created to provide information about our company and its mobile application services for education institutions (such education institutions, our “Client(s”) (such services, together with the Site, the “Service(s)”) to our users (“you”, “your”). This Privacy Policy sets forth OOHLALA Mobile’ policy with respect to information, including personally identifiable data (“Personal Data”), and other information that is collected from Site visitors and users of the Services. The use of information collected through our Service shall be limited to the purpose of providing the services for which the applicable Client has engaged OOHLALA Mobile as set forth in this Privacy Policy.

Important disclosures and consents:

Unlimited data and messaging plans are recommended for our Services. For some services, we require the use of SMS text messages. Standard data and messaging charges and taxes from your carrier apply.

We collect, maintain and use the geographic location of your mobile device (we call this location fix of your device “location information” or “geo-location”) to provide our Services.

By using the OOHLALA Mobile Services, you have consented to: (1) the use of your device's location to provide our services; (2) receive emails; and (3) pay carrier data, messaging, and other fees resulting from OOHLALA Mobile usage.

The OOHLALA Mobile Services default privacy settings are set for the way that most Users use the services, changing these settings is easy, select “Settings” under your profile on the OOHLALA Mobile application.

Please note that any personal information you voluntarily disclose online becomes publicly available and can be read, collected, and used by others. OOHLALA Mobile is not responsible for the information that you choose to disclose publicly on or through the OOHLALA Mobile Services.

Information We Collect:

When you interact with us through the Site or the Services, we may collect Personal Data and other information from you, as further described below:

Personal Data That You Provide Through the Service

We collect the following kinds of personal information from our Clients:

Contact information such as name, email address

Application registration information such as email address, name, gender and date of birth

Unique identifiers such as user name, account number or name, password

Location information derived from your wireless carrier, certain third-party service providers, or directly from the mobile device that you used to register. This location tracking of your mobile device may occur even when the Site is not actively open and running in the foreground.

We use this information to:

Send you an order confirmation

Respond to customer service requests

Administer your account

Operate, maintain and provide to you the features and functionality of the Services including those features and functionalities requiring location information (Map, GPS Directions, Campus Tours, Virtual Treasure Hunt).

By providing OOHLALA Mobile your email address, you consent to our using the email address to send you Service-related notices, including any notices required by law, in lieu of communication by postal mail. We may also use your email address to send you other messages, such as newsletters, changes to features of the Service, or special offers. If you do not want to receive such messages, you may opt out or change your preferences in your in-app Settings, under Notifications. Opting out may prevent you from receiving messages regarding updates, improvements, or offers. You may not opt out of Service-related e-mails. If you correspond with us by email, we may retain the content of your email messages and our responses.

OOHLALA Mobile collects information under the direction of its Clients, and has no direct relationship with the individuals whose Personal Data it processes. OOHLALA Mobile works with its Clients to help them provide notice to their customers concerning the purpose for which Personal Data is collected.

OOHLALA Mobile has no direct relationship with the individuals whose Personal Data it processes. An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data should direct his/her query to the Client’s Administrator (the data controller). If the Client requests OOHLALA Mobile to remove the data, we will respond to their request within 30 business days.

Personal Data That You Provide Through the Site:

We collect Personal Data from you when you voluntarily provide such information such as when you access the Services (for example, your name, email address, phone number, mailing address and device information) use certain Services, or contact us with inquiries. Wherever OOHLALA Mobile collects Personal Data we make an effort to provide a link to this Privacy Policy.

By voluntarily providing us with Personal Data, you are consenting to our use of it in accordance with this Privacy Policy. If you provide Personal Data, you acknowledge and agree that such Personal Data may be transferred from your current location to the offices and servers of OOHLALA Mobile and the authorized third parties referred to herein.

Non-Identifiable or Aggregated Data:

When you interact with OOHLALA Mobile through the Site or Services, we receive and store certain personally non-identifiable information. Such information, which is collected passively using various technologies, cannot presently be used to specifically identify you. OOHLALA Mobile may store such information itself or such information may be included in databases owned and maintained by OOHLALA Mobile affiliates, agents or service providers. We may use such information and pool it with other information to track, for example, the total number of visitors to our Site, the number of visitors to each page of our Site, the domain names of our visitors’ Internet service providers, and how our users use and interact with the Services. Also, in an ongoing effort to better understand and serve the users of the Services, OOHLALA Mobile often conducts research on its customer demographics, interests and behavior based on the Personal Data and other information provided to us. This research may be compiled and analyzed on an aggregate basis. OOHLALA Mobile may share this non-identifiable and aggregate data with the business you work for and our affiliates, agents and business partners, but this type of non- identifiable and aggregate information does not identify you personally. OOHLALA Mobile may also disclose aggregated user statistics in order to describe our Services to current and prospective business partners, and to other third parties for other lawful purposes.

In operating the Site and Services, we also use a technology called “cookies.” A cookie is a piece of information that the computer that hosts our Services gives to your browser when you access the Services. We do not link the information we store in cookies to any personally identifiable information you submit while on our Site. Our cookies help provide additional functionality to the Site and Services and help us analyze Service usage more accurately. For instance, our Site and Services may set a cookie on your browser that allows you to access the Services without needing to remember and then enter a password more than once during a visit to the Services. In all cases in which we use cookies, we will not collect Personal Data except with your permission. On most web browsers, you will find a “help” section on the toolbar. Please refer to this section for information on how to receive notification when you are receiving a new cookie and how to turn cookies off. We recommend that you leave cookies turned on because they allow you to take advantage of some of the Service features.

The use of cookies by our partners on the Site and Services is not covered by our Privacy Policy. We do not have access or control over these cookies. Our partners use session ID cookies to make it easier for you to navigate our Site.

We use third party tracking-utility partners to gather certain information automatically and store it in log files. This information includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, clickstream data, number of clicks, search terms, time spent on particular pages, pages viewed the order in which pages are viewed, features used on the Site and Services, the frequency with which you use features on the Site and Sevices, and one or more cookies that may uniquely identify your browser.

We use this information, which does not identify individual users, to analyze trends, to administer the Site, to track users’ movements around the Site and to gather demographic information about our user base as a whole.

Our Use of Your Personal Data and Other Information:

OOHLALA Mobile uses the Personal Data you provide in a manner that is consistent with this Privacy Policy. If you provide Personal Data for a certain reason, we may use the Personal Data in connection with the reason for which it was provided. For instance, if you contact us by email, we will use the Personal Data you provide to answer your question or resolve your problem. Also, if you provide Personal Data in order to obtain access to the Services, we will use your Personal Data to provide you with access to such services and to monitor your use of such services. OOHLALA Mobile and its subsidiaries and affiliates (the “Related Companies”) may also use your Personal Data and other personally non-identifiable information collected through the Service to help us improve the content and functionality of the Service, to better understand our users and to improve the Services. OOHLALA Mobile may use this information to communicate with you regarding the Services or to tell you about services we believe will be of interest to you. If we do so, each marketing communication we send you will contain instructions permitting you to “opt-out” of receiving future marketing communications. Note however that as user of the Service you cannot opt-out of some administrative communications that are reasonably necessary to the Service, such as billing or service notifications. In addition, if at any time you wish not to receive any future marketing communications or you wish to have your name deleted from our mailing lists, please contact us as indicated below.

Our Site includes “Widgets,” such as the “share this” feature or other interactive mini-programs that run on our Site. These Widget features may collect your IP address and which page you are visiting on our Site and may set a cookie to enable the Widget feature to function properly. Social media features and Widgets are either hosted by a third party or hosted directly on our Site. Your interactions with such features are governed by the privacy policy of the company providing it.

If OOHLALA Mobile intends on using any Personal Data in any manner that is not consistent with this Privacy Policy, you will be informed of such anticipated use prior to or at the time at which the Personal Data is collected.

Our Disclosure of Your Personal Data and Other Information:

OOHLALA Mobile is not in the business of selling your information. We consider this information to be a vital part of our relationship with you. We will share your Personal Data with third parties only in the ways that are described in this Privacy Policy. There are, however, certain circumstances in which we may share your Personal Data with certain third parties without further notice to you, as set forth below:

Business Transfers:

As we develop our business, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, dissolution or similar event, Personal Data may be part of the transferred assets. Related Companies:

Agents, Consultants and Related Third Parties:

OOHLALA Mobile, like many businesses, sometimes hires other companies to perform certain business related functions. Examples of such functions include an email service provider that sends out mailing information on our behalf and a hosting provider for maintaining our databases. When we employ another company to perform a function of this nature, we only provide them with the information that they need to perform their specific function.

Legal Requirements:

OOHLALA Mobile may disclose your Personal Data if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, (ii) protect and defend the rights or property of OOHLALA Mobile, (iii) act in urgent circumstances to protect the personal safety of users of the Services or the public, or (iv) protect against legal liability.

Your Choices:

You can use the Site without providing any Personal Data. If you choose not to provide any Personal Data, you may not be able to use certain Services.

Exclusions:

This Privacy Policy does not apply to any Personal Data collected by OOHLALA Mobile other than Personal Data collected through the Site or Services. This Privacy Policy shall not apply to any unsolicited information you provide to OOHLALA Mobile through this Site or through any other means. This includes, but is not limited to, any ideas for new products or modifications to existing products, and other unsolicited submissions (collectively, “Unsolicited Information”). All Unsolicited Information shall be deemed to be non-confidential and OOHLALA Mobile shall be free to reproduce, use, disclose, distribute and exploit such Unsolicited Information without limitation or attribution. OOHLALA Mobile does not knowingly collect Personal Data from children under the age of 14: If you are under the age of 14, please do not submit any Personal Data through the Services. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce our Privacy Policy by instructing their children never to provide Personal Data on this Site without their permission.

Public Areas:

Our Site may offer publicly accessible blogs or community forums (“Public Areas”). You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. In some cases, we may not be able to remove your personal information, in which case we will let you know if we are unable to do so and why.

Links to Other Web Sites:

This Privacy Policy applies only to the Services. The Service may contain links to other web sites or apps not operated or controlled by OOHLALA Mobile (the “Third Party Sites”). The policies and procedures we described here do not apply to the Third Party Sites. The links from the Service do not imply that OOHLALA Mobile endorses or has reviewed the Third Party Sites. We suggest contacting those sites directly for information on their privacy policies.

Security:

OOHLALA Mobile takes reasonable steps to protect the Personal Data provided via the Site and Services from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. The security of your Personal Data and our Clients’ information is important to us. When you enter sensitive information (such as login credentials) we encrypt the transmission of that information using secure socket layer technology (SSL). However, no Internet, email or other electronic transmission is ever fully secure or error free, so you should take special care in deciding what information you send to us in this way. Access to Information; Contacting OOHLALA Mobile:

We will retain your Personal Data for as long as your account is active or as needed to provide you services.
